1. BINDING AGREEMENT
1.1. These Parent Sense App Terms and Conditions (the “Agreement”) constitute a binding agreement between you, the User, and Sense-IT Limited (“us”, “we”) regarding your access and use of the Parent Sense mobile application and our websites currently located at www.parentsense.app, www.megfaure.com and www.sense.megfaure.com, as well as any other media form, media channel, mobile website or mobile application related or linked thereto (collectively, the “Site”).
1.2. By accessing the Site or the Content, you confirm that you have read, understood and agree to the terms of this Agreement. If you object to any term, you have the option not to proceed with accessing the Site or the Content.
1.3. When you access the Site or the Content, you warrant that you have legal capacity and are not a minor in the jurisdiction governing this Agreement, alternatively that you have your parents’ or legal guardians’ authorisation, consent and permission.
1.4. This Agreement is effective immediately upon your accessing the Site or the Content.
1.5. We reserve the right to update this Agreement at any time. The date of the most recent update is reflected above. Your continued access to the Site or Content after any update constitutes acceptance of the updated terms.
1.6. For information about how we process your personal data, please refer to our Privacy Policy, which is incorporated by reference in this Agreement.

2. SERVICES PROVIDED
2.1. The Content provided on and through the Site was created and/or curated by, or in collaboration with allied health professionals, Meg Faure (Occupational Therapist) and paediatric dietician, Kath Megaw.
2.2. Using content created by Meg Faure and collaborators, we have developed the Aiah AI chatbot. Aiah is designed to help parents by providing direct advice and appropriate responses to their questions.
2.3. We do not represent Meg Faure, Kath Megaw or any person affiliated with us to be registered, qualified, engaged or practising in any particular field or occupation.
2.4. The Site and Content are intended for guidance purposes only and do not constitute professional advice of any kind. We recommend that you seek advice from a qualified professional in your area.

3. USING OUR CHATBOT (AIAH)
3.1. The Aiah chatbot is designed using artificial intelligence software, including OpenAI’s ChatGPT technology. Its responses are not vetted or reviewed by a person in real time.
3.2. Aiah uses our curated library of learning material to answer your questions and improve its responses over time. Where a question cannot be answered using our library, the chatbot may draw on its prior AI knowledge.
3.3. Responses generated by the chatbot are for information purposes only. We cannot guarantee their accuracy. Aiah is not a medical device or software and responses should not be treated as a substitute for professional advice. We shall not be liable for any claims or losses resulting from reliance on chatbot responses.
3.4. We take all reasonable measures to ensure chatbot availability but cannot be held responsible for loss experienced due to technical issues or downtime.
3.5. The chatbot is primarily trained on English-language material. You may use other languages but accuracy may vary and we accept no liability for such inaccuracy.
3.6. We reserve the right to limit interactions where you are making repetitive or excessive prompts or prompts in violation of these Terms.
3.7. The Aiah chatbot is powered by OpenAI’s ChatGPT. By using the Services, you agree to be bound by OpenAI’s policies. Disallowed uses include: illegal activity; child sexual abuse material; hateful, harassing or violent content; generation of malware; activity with high risk of physical or economic harm; fraudulent or deceptive activity; adult content; political campaigning; privacy violations; unauthorised practice of law or medicine; and high-risk government decision-making.
3.8. If you encounter chatbot responses that resemble any disallowed use, please report this to us at [email protected].

4. LIMITATION OF LIABILITY AND INDEMNITY
4.1. Limitation of liability: You access and use the Site and Content at your own risk. We will not be liable for any Loss arising from your use of the Site, inability to access it, or reliance on its Content, to the fullest extent permitted by law.
4.2. Vaccination information: We currently only provide vaccination information for a limited number of jurisdictions. It is your responsibility to obtain correct vaccination information for your jurisdiction.
4.3. Indemnity: You agree to indemnify and hold us harmless from any claim or demand arising out of your breach of this Agreement or your violation of any law or the rights of a third party.
4.4. No warranty on third party content: We do not make any warranties about the content of the Site or any third-party websites referred to or accessible from it. We disclaim all warranties implied by law to the fullest extent permitted.
4.5. No representation on safety of use: We do not represent that the Site is free of viruses, bugs or similar harmful elements, or that it is compatible with all devices and browsers.
4.6. No liability on third party events, services or products: We do not endorse any events, products or services listed on our Site by third parties. All arrangements with third parties are at your own risk.

5. ACCESS
5.1. Access to the Site and Content is reserved for natural persons with legal capacity, over the age of majority in the applicable jurisdiction.
5.2. As a Jersey resident accessing the app through the Impact Jersey (Digital Jersey) programme, your access to the full Parent Sense App is provided free of charge for the duration of the programme.
5.3. We grant you a non-exclusive, non-transferable, revocable, limited licence to view and use the Content from the Site for your personal, non-commercial use only.
5.4. You agree to keep your registration details, and in particular your password, confidential.
5.5. We reserve the right to refuse or discontinue access to the Site at any time, without providing a reason.

6. YOUR ACCESS AS A JERSEY PROGRAMME USER
6.1. The Parent Sense App is made available to you free of charge through a programme funded by the Government of Jersey and administered by Digital Jersey Limited (trading as Impact Jersey) (the “Jersey Programme”).
6.2. Anonymised and aggregated engagement data derived from Jersey-based users of the platform (“the Data Set”) will be shared with Digital Jersey and/or the Government of Jersey for the purposes of public health policy, programme evaluation, and development of Jersey’s digital health ecosystem. This data will not contain any personal data or information from which you could be identified. See our Privacy Policy for full details.
6.3. We will acknowledge the role of Digital Jersey / Impact Jersey in public materials relating to the Jersey Programme, and we may be required to participate in promotional or evaluation activities relating to the programme.
6.4. Nothing in this clause limits your rights under the Data Protection (Jersey) Law 2018 or our obligations under our Privacy Policy.
6.5. Access to the programme is available to Jersey residents from pregnancy through to when your youngest child reaches five years of age, in line with the programme’s eligibility criteria.

7. AIAH AI CHATBOT — SUBSCRIPTION AND ACCESS
7.1. Free Access for Jersey Users: As a Jersey Programme participant, you have free access to the Aiah chatbot for the duration of the programme, with no message limit restrictions applied at the programme level.
7.2. Data Handling After Cancellation or Programme End: Upon the end of the programme or any subscription, all personal data will be processed in accordance with our Privacy Policy.

8. NOTIFICATION AND PERMISSIONS
8.1. You accept that the Site will need certain permissions (including notifications on your mobile device) to function as designed. If you do not provide these permissions, the Site may not function fully.
8.2. We accept no liability for any Loss if you can no longer access or use the Site in the same manner if you do not grant adjusted permissions.

9. INTELLECTUAL PROPERTY
9.1. The Site and all Content, including designs, trademarks, service marks, trade names and URLs, are our property and are protected by intellectual property law.
9.2. We own all intellectual property rights in compilations, collective works and derivative works created by us which may incorporate user content.
9.3. No part of this Site may be used, copied or reproduced other than for viewing its Content for personal, non-commercial use.
9.4. If you submit any content to our website, you grant us an irrevocable, perpetual, worldwide, royalty-free licence to use, compile, display, publish, reproduce, distribute, adapt, modify and promote such content in any manner or form.
9.5. Anonymised and aggregated data derived from Jersey users of the platform may be used by us to improve, develop and train the Parent Sense platform and its AI models globally, in accordance with our Grant Agreement with Digital Jersey and subject to applicable data protection law.

10. WARRANTIES
You hereby warrant that:
All registration information you submit is true, accurate, current and complete.
You will maintain the accuracy of such information.
You will abide by OpenAI’s Usage Policy and shall not interfere with the operation of the Services or chatbot.
You understand that information you input into the chatbot may be used to improve the chatbot and will be processed in accordance with our Privacy Policy.
You will use the Site only for legal and authorised purposes.
Your use of the Site will not violate any applicable law or regulation.

11. PROHIBITIONS ON USE
Unless you have our prior written specific permission, you may not:
Use the Site for any purpose other than that for which we make it available.
Sell or transfer your account.
Use the Site in a manner that would bring us into disrepute.
Access the Site through automated or non-human means.
Systematically retrieve data or Content to create databases or directories without our prior written permission.
Use the Site to advertise or offer to sell goods or services.
Circumvent, disable or otherwise interfere with security-related features.
Attempt to decompile, disassemble, reverse engineer or adapt any software comprising the Site.

12. FORUMS
12.1. We may provide space for discussion between Users on our Site. You are responsible for anything you submit or post, and you will be solely liable for any Loss arising from it.
12.2. We do not control or screen content posted by members or third parties and do not guarantee its accuracy, integrity or quality.
12.3. We reserve the right to remove any material and to suspend or terminate your access at any time without notice.

13. GOVERNING LAW
13.1. This Agreement shall be governed and construed in accordance with the laws of the Bailiwick of Jersey and you hereby irrevocably submit to the non-exclusive jurisdiction of the Jersey courts.
13.2. You agree to use this Site in accordance with these Terms and all applicable Jersey laws, regulations and codes of conduct, and only for lawful purposes that do not infringe the rights of, or restrict the enjoyment of the Site by, any third party.

15. INTERPRETATION
15.1. In this Agreement, clause headings are for convenience only. References to the singular include the plural and vice versa; references to one gender include all genders; references to natural persons include legal persons and vice versa.
15.2. Key definitions:
“Business Day” means a day (other than a Saturday, Sunday or public holiday) on which banks are open for normal business in Jersey.
“Content” means any information, data, text, software, sound, photographs, graphics, video, messages, courses, podcasts, comments, guidance, articles, feedback, suggestions and tags contained on the Site.
“Loss” includes any claims, loss of profit, revenues, goodwill, opportunity, business, anticipated saving and/or other direct, indirect or consequential loss of any kind.
“Member” means any registered User of our Site.
“us”/”we” refers to Sense-IT Limited (registered in Jersey at Floor 4, Liberation House, Castle St, St Helier, Jersey JE1 4HH), including our parent company, subsidiaries, officers, employees, owners, affiliates, directors, agents and suppliers.
“User” means any user of the Site.
“you” means a User.
